Welcome to HomeVista. These Terms and Conditions set out how we work with you, from your first quote through to the finished install, and we request you to read this policy page content before you place an order. 

When you accept a quote, pay a deposit, or place an order, you’re agreeing to these terms. If anything, here isn’t clear, ask us before you go ahead. We’re happy to explain. 

About These Terms 

These terms apply to every quote, order and installation we provide, unless we’ve agreed something else with you in writing. Read them alongside our Privacy Policy and the details on your quote, order form or invoice. If those documents ever disagree, the details on your signed order form win for that order. 

Do note that HomeVista may update these terms now and then. The version that applies to your order is the one in place on the day you accepted your quote. 

Definitions 

To keep things clear: 

“HomeVista”, “we”, “us” and “our” mean Homevista [insert full legal / trading name and ABN]
“You” and “your” mean the person or business that asks for a quote, places an order, or receives our products or services. 
“Products” means the curtains, blinds, shutters, tracks, motors, controls and any other goods we supply. 
“Services” means our measuring, design advice, manufacturing, delivery and installation. 
“Custom-made” means anything made, cut, sewn, assembled or finished to your specific windows, sizes or chosen options. 
“Order” means a quote you’ve accepted. 

Quotes & Pricing 

We base every quote on the products, sizes, and options we discussed at the time. Unless we say otherwise, a quote holds for 30 days. After that we may need to re-quote since material costs move. 

Unless otherwise indicated, prices are expressed in Australian dollars and include GST. A quote is only an estimate until you accept it. On its own, it isn’t a binding order. 

If the job changes after you accept it – say, you switch fabrics, add windows, or the measurements come back different – the price can change to match. We’ll always tell you before doing the extra work. 

A quote only covers the job we described. It doesn’t include work we couldn’t have known about beforehand, such as unusual fixings or repairs to a wall. If something like that comes up, we’ll quote it separately. 

Placing An Order 

Your order starts once you accept a quote in writing (email or a signed order form both count) and pay any deposit we’ve asked for. At that point, a legally enforceable agreement is established. 

Please check your order confirmation closely, the sizes, colours, fabrics, controls and quantities, and tell us right away if something looks off. Because we make your order specifically for you, we manufacture according to the confirmed specifications. 

Deposits & Payment 

Since your order is made to measure, we ask for a deposit before we start making it and the amount is shown on your quote or order form. 

The balance falls due on or before installation, unless we’ve agreed otherwise in writing. We may hold off starting, delivering, or installing while any payment is outstanding. 

You’ll find the accepted payment methods on your invoice. If an account isn’t paid by its due date, we may charge reasonable recovery costs and interest on the overdue amount at a reasonable rate, as far as the law allows. 

Gst & Tax Invoices 

Prices include GST where it applies, and we’ll give you a tax invoice. If a tax or government charge changes between your quote and manufacture, we may adjust the price to reflect it, and we’ll let you know first. 

Measurements 

Getting the sizes right is the most important part of a custom order, so we recommend you let us measure. 

When we measure, the sizing is on us. If something doesn’t fit because we measured wrong, we’ll remake or refit it at no cost to you. 

When you give us your own measurements, we make the order for those sizes. In that case, we can’t take responsibility for a product that doesn’t fit because the measurements were off, and any remake is charged at full price. 

Custom-made Products & Change Of Mind 

Nearly everything we supply is made for your windows and your chosen options, so we can’t resell it to anyone else. 

That’s why custom-made products can’t be returned, exchanged, or refunded because you’ve changed your mind, and that includes picking the wrong colour, size or style, or simply deciding you don’t want them anymore. Please take your time choosing and confirm your details before we begin. 

None of this affects your rights if a product turns out to be faulty. Those are covered by the Australian Consumer Law (see section 14). 

Colours, Materials & Natural Variation

On a computer screen, a sample swatch, and the real product in your immediate environment, colours and textures might look different. Our goal is to present pictures that are as authentic as we can. Please be advised, though, that we are unable to guarantee that a colour or texture will precisely match an image or swatch. 

Natural materials such as timber have variations in grain, shade, and finish inherent in the material. This is characteristic of the materials used and should be expected. You may also notice some variation in different lots of the same fabric. 

If the fabric or product you have chosen is discontinued prior to dispatch of your order, we will contact you so that an alternative can be selected. 

Lead Times, Delivery & Storage 

Because production and supplier schedules can change, we’ll give you an honest estimate of how long it will take to make and fit your order rather than a set guarantee. 

We’ll keep you posted if the timing changes. We’re not liable for delays beyond our reasonable control (see section 17). 

If your order is finished but you can’t take delivery or installation within a reasonable time, we may ask for the balance and charge a reasonable amount to store your goods while we hold them. 

Installation & Site Conditions 

We require safe, clear access to your windows and electricity when needed on the day of installation. Please clear the work area of fragile items and furniture prior to our arrival. 

Our fitters work with the surfaces on-site. Some walls, ceilings or window reveals may be unsafe to fix to. If so, we will talk to you about the options available, and there could be an extra charge for materials or work. 

If the site is not ready, we cannot gain access, or if the surfaces are not suitable, we may need to reschedule and charge for the return visit to complete the install. 

We Care. In Your Home. We can’t be responsible for pre-existing problems or for the minor unavoidable marks that are part and parcel of fixing certain surfaces. But, if we cause damage through our own carelessness, we’ll put it right. 

Motorised & Electrical Products 

Some products come with motors, remotes, batteries or smart-home controls, and please note that any hard-wired electrical work has to be done by a licensed electrician. Unless your quote clearly includes that electrical work, you arrange and pay for it separately. 

We’ll show you how to use and pair your motorised products. Whether they work with a particular smart-home system or a voice assistant, say, or a home-automation app, depends on that system, which we don’t run, and which can change with its own updates. 

Title & Risk 

The products stay ours until you’ve paid in full. Once they’re delivered or installed, responsibility for any loss or damage passes to you, even if the balance is still owing. 

Until we’re paid in full, please don’t sell, remove or alter the products, and allow us reasonable access to inspect or collect them if the account stays unpaid. 

Warranty & Your Consumer Rights 

Our goods and services come with guarantees that can’t be excluded under the Australian Consumer Law. If a product has a major failure, you can choose a replacement or a refund, and you may be entitled to compensation for any other loss that was reasonably foreseeable. If the failure is minor, we’ll repair it within a reasonable time or replace it, whichever we decide. 

On top of that, many products carry a manufacturer’s warranty against faults in materials or workmanship. The length and terms vary by product, and we’ll tell you what applies to your order. 

Warranties don’t cover everyday wear and tears, fading over time, accidental damage, misuse, or the wrong cleaning. They also don’t cover repairs or changes made by anyone other than us, or problems that come from conditions in the home, such as damp or a building’s fault. 

To make a claim, contact us with your order details and a description of the problem, along with photos if you can. 

Care & Maintenance 

Looking after your products keeps them working well and protects your warranty. We’ll give you care instructions for what you’ve bought, and there are care guides on our website too. 

Damage caused by cleaning them the wrong way, or by neglect, isn’t covered by warranty. 

Cancellations & Changes 

You can change or cancel your order any time before it goes into manufacturing. We may charge for work already done, such as measuring or design time, and your deposit may not be fully refundable. 

Once we’ve started making your order, it can’t be cancelled, because it’s being built specifically for you. If you cancel after that point, you may have to pay the full order price. 

Things Outside Our Control 

Now and then, something happens that neither of us can control, a natural disaster, a pandemic, a supply shortage, a freight disruption, industrial action, or a change in the law. If one of these stops us meeting our obligations or holds us up, we’re not in breach of these terms, and we’ll agree a new timeframe with you as soon as we reasonably can. 

Subcontractors 

Sometimes we bring in qualified subcontractors, for installation or electrical work, for example. When we do, we’re still responsible to you for the work we agreed to provide, and our standards still apply. 

Our Liability 

Nothing in these terms takes away any right you have under the Australian Consumer Law or other laws that can’t be excluded. 

As far as the law allows, we’re not liable for indirect or flow-on losses. Our total liability for any claim tied to an order is limited, at our choice, to repairing or replacing the products, doing the services again, or refunding what you paid for the products or services involved. 

We’re also not responsible for faults already present in your walls, windows or fittings that only show up during measuring or installation. 

Complaints & Dispute Resolution 

If something isn’t right, we want to hear about it so we can fix it. Please contact us first with the details of your order. We aim to sort most things out quickly and directly. 

If we can’t resolve it between us, either of us can take the matter to the consumer affairs or fair trading body in your state or territory or use another option available under Australian law. 

Privacy 

We handle your personal information under our Privacy Policy and the Australian Privacy Principles. In short: we only collect what we need to do our job, we keep it secure, and we don’t sell it. You’ll find the full Privacy Policy on our website. 

Intellectual Property 

Everything on our website and in our materials – the text, images, designs, logos and branding – belongs to HomeVista or the people who license it to us. Please don’t copy or reuse it without our written permission. 

Website Use 

Our website is here for general information. We try to keep it accurate and up to date, but we can’t promise it’s always error-free or available. Treat the images and descriptions online as a guide; your custom order is made to the specifications confirmed on your order form. 

General 

If part of these terms turns out to be invalid, the rest still stands. If we don’t act on a term straight away, we haven’t given up the right to act on it later. You can’t hand your order or these terms to someone else without our agreement. 

Governing Law 

These terms are governed by the laws of [insert state / territory], Australia, and you and we accept the non-exclusive jurisdiction of that state’s courts.
